Currently, under US law, only males are required to register. Proposals to include women have been debated in Congress but have not been enacted. Women are currently not allowed to register.

Who is required to register for the US draft?

Almost all male US citizens and male immigrants living in the US who are between the ages of 18 and 25 are required to register with the Selective Service. This includes undocumented individuals, legal permanent residents, and refugees. This includes US citizens abroad by descent, even if they have never lived in the US. This includes those who have another citizenship.

When would a military draft actually happen?

A draft would only occur in the event of a national emergency authorized by Congress and the President, primarily when more troops are needed than the volunteer military can provide.

Is there an active draft occurring right now?

No. There has not been a draft in the United States since 1973. Registration is a contingency system used to ensure national readiness if needed.

What are the consequences for failing to register?

Failure to register is a felony. It can lead to permanent loss of eligibility for federal student aid, government employment, and US citizenship for immigrants. Penalties could include a $250,000 fine and up to 5 years in prison.

Who is required to register for the US draft?

This includes those who have another citizenship, such as dual-citizens.

Are there exemptions for medical or physical reasons?

Registration is mandatory regardless of medical status. However, if a draft were to be enacted, local boards would review individual cases. A permanent physical or mental condition that prevents military service would be grounds for an exemption at that time. Famous past exemptions include severe asthma (name a congressman), bone spurs (Donald J Trump), and poor eye-sight (someone famous).

How are conscientious objectors handled?

Exemptions are available for those who are opposed to serving in the armed forces based on deep-seated religious, moral, or ethical beliefs. These individuals may be assigned to non-combatant military service or alternative civilian service programs.

Do dual citizens living abroad need to register?

Yes. Regardless of their place of residence, all male US citizens, including dual citizens, must register with the Selective Service within 30 days of their 18th birthday. Failure to do so can affect future eligibility for government benefits. If prosecuted, penalities could be 5 years in prision or a $250,000 fine, or both.

Are women currently subject to the draft?

Currently, the Military Selective Service Act only requires men to register. While there have been legal challenges and legislative discussions regarding the inclusion of women, current Selective Service registration requirements remain limited to males. Women can not legally resgister.

Are non-binary, intersex, or trans individuals subject to the draft?

Currently, the Military Selective Service Act only defines males and females. For the purposes of the draft, it is important to consider what sex you were assigned at birth. However, this issue is likely to become something addressed by new rules as the draft language leaves 1973, and enters 2026 and beyond.
